Required Documents for the Registration of a Divorce Judgment in Italy
To register a divorce judgment in Italy, the following documents must be submitted:
Request for Transcription of the Divorce Judgment
- A completed form with accurate details of the ex-spouse (correct data entry is essential).
Affidavit
- A signed affidavit form containing important declarations related to the divorce.
Final Judgment of Dissolution of Marriage
- Do not include marital settlement agreements or additional attachments.
Apostille of the Final Judgment of Divorce
- Must be issued by the competent authority in the country/state where the judgment was finalized.
Translation into Italian of the Final Judgment
- The entire document must be translated word for word from the first to the last row.
- Given the legal terminology involved, we strongly recommend using a qualified translator.
Certificate of No Appeal
- A document certifying that the divorce judgment is final and not subject to appeal.
- If this certificate is not issued by the court, an official Report of Dissolution of Marriage from the Vital Statistics Office can be provided instead.
Apostille of the Certificate of No Appeal (or Report of Dissolution of Marriage)
- This ensures the document’s validity for use in Italy.
Translation into Italian of the Certificate of No Appeal (or Report of Dissolution of Marriage)
- The entire document must be translated into Italian, adhering to legal accuracy.
Photocopy of the Italian Passport
- A clear copy of the applicant’s Italian passport must be included.
If the certificate is a document other than A4, and/or printed on both side, and/or with glued attachments, please provide a copy of each side on a single face sheet.
