{"id":6340,"date":"2025-11-07T12:45:57","date_gmt":"2025-11-07T17:45:57","guid":{"rendered":"https:\/\/consmiami.esteri.it\/?page_id=6340"},"modified":"2026-03-12T12:56:32","modified_gmt":"2026-03-12T16:56:32","slug":"powers-of-attorney-procure","status":"publish","type":"page","link":"https:\/\/consmiami.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/notary-services\/powers-of-attorney-procure\/","title":{"rendered":"Powers of Attorney (Procure)"},"content":{"rendered":"<p style=\"text-align: justify;\" data-start=\"22\" data-end=\"317\">A <strong data-start=\"24\" data-end=\"45\">power of attorney<\/strong> authorizes another person to act on your behalf and to carry out the actions necessary to achieve a specific purpose (e.g., selling or purchasing property, managing assets, making or accepting a donation, forming or dissolving a company, etc.).<\/p>\n<p style=\"text-align: justify;\" data-start=\"319\" data-end=\"363\">Powers of attorney fall into two categories:<\/p>\n<p style=\"text-align: justify;\" data-start=\"365\" data-end=\"393\"><strong><span style=\"text-decoration: underline;\">General Power of Attorney<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\" data-start=\"394\" data-end=\"736\">With a general power of attorney, the principal authorizes the agent to manage <strong data-start=\"473\" data-end=\"507\">all present and future affairs<\/strong>. It is issued for an <strong data-start=\"529\" data-end=\"548\">indefinite term<\/strong> and grants <strong data-start=\"560\" data-end=\"581\">very broad powers<\/strong>. This type of power of attorney should be given only to someone in whom you have the utmost trust and <strong data-start=\"684\" data-end=\"710\">requires two witnesses<\/strong> at the time of signature.<\/p>\n<p style=\"text-align: justify;\" data-start=\"738\" data-end=\"766\"><strong><span style=\"text-decoration: underline;\">Special Power of Attorney<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\" data-start=\"767\" data-end=\"1074\">With a special power of attorney, the principal authorizes the agent to manage <strong data-start=\"846\" data-end=\"866\">specific matters<\/strong> and perform actions aimed at a <strong data-start=\"898\" data-end=\"917\">defined purpose<\/strong> (e.g., the sale of real property). A special power of attorney <strong data-start=\"981\" data-end=\"1007\">ceases to be effective<\/strong> once the specific task for which it was issued has been completed.<\/p>\n<p data-start=\"767\" data-end=\"1074\"><span style=\"text-decoration: underline;\"><strong>Please note that this service is reserved exclusively for Italian citizens.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\" data-start=\"1081\" data-end=\"1093\"><strong><span style=\"text-decoration: underline;\">Procedure<\/span><\/strong><\/p>\n<p data-start=\"0\" data-end=\"126\">Anyone wishing to grant a power of attorney \u00a0must schedule an appointment through the <a href=\"https:\/\/prenotami.esteri.it\/\"><strong data-start=\"105\" data-end=\"125\">Prenot@Mi portal<\/strong>.<\/a><\/p>\n<p data-start=\"128\" data-end=\"283\">Once the appointment has been booked, a detailed email will be sent with instructions and the documentation required for the appointment, summarized below:<\/p>\n<ul data-start=\"285\" data-end=\"740\" data-is-last-node=\"\" data-is-only-node=\"\">\n<li data-section-id=\"lfe8zn\" data-start=\"285\" data-end=\"399\">\n<p data-start=\"287\" data-end=\"399\">a draft prepared by an Italian notary or attorney, complete with all relevant information, in <strong data-start=\"381\" data-end=\"396\">Word format<\/strong>;<\/p>\n<\/li>\n<li data-section-id=\"sempy\" data-start=\"400\" data-end=\"711\">\n<p data-start=\"402\" data-end=\"539\">the draft must include the following information for the <strong data-start=\"459\" data-end=\"472\">principal<\/strong>, the <strong data-start=\"478\" data-end=\"498\">attorney-in-fact<\/strong>, and any <strong data-start=\"508\" data-end=\"521\">witnesses<\/strong>, if applicable:<\/p>\n<ul data-start=\"542\" data-end=\"711\">\n<li data-section-id=\"bwokfi\" data-start=\"542\" data-end=\"599\">\n<p data-start=\"544\" data-end=\"599\">first and last name (for married women, maiden name);<\/p>\n<\/li>\n<li data-section-id=\"mx5ymz\" data-start=\"602\" data-end=\"630\">\n<p data-start=\"604\" data-end=\"630\">date and place of birth;<\/p>\n<\/li>\n<li data-section-id=\"1xfg77b\" data-start=\"633\" data-end=\"647\">\n<p data-start=\"635\" data-end=\"647\">residence;<\/p>\n<\/li>\n<li data-section-id=\"rmp2mv\" data-start=\"650\" data-end=\"666\">\n<p data-start=\"652\" data-end=\"666\">citizenship;<\/p>\n<\/li>\n<li data-section-id=\"1pwunc1\" data-start=\"669\" data-end=\"711\">\n<p data-start=\"671\" data-end=\"711\">Italian tax code (<strong data-start=\"689\" data-end=\"707\">codice fiscale<\/strong>).<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li data-section-id=\"1rfssj3\" data-start=\"713\" data-end=\"740\" data-is-last-node=\"\">\n<p data-start=\"715\" data-end=\"740\" data-is-last-node=\"\">a valid Italian passport.<\/p>\n<\/li>\n<\/ul>\n<p style=\"text-align: justify;\" data-start=\"1694\" data-end=\"1796\"><strong data-start=\"1694\" data-end=\"1796\">Additional documentation may be required depending on the subject matter of the power of attorney.<\/strong><\/p>\n<ul style=\"text-align: justify;\" data-start=\"1798\" data-end=\"2137\">\n<li data-start=\"1798\" data-end=\"1959\">\n<p data-start=\"1800\" data-end=\"1959\">For <strong data-start=\"1804\" data-end=\"1819\">real estate<\/strong> matters (transfer of ownership or other real rights), the property must be <strong data-start=\"1895\" data-end=\"1919\">precisely identified<\/strong>, including <strong data-start=\"1931\" data-end=\"1956\">cadastral information<\/strong>.<\/p>\n<\/li>\n<li data-start=\"1960\" data-end=\"2137\">\n<p data-start=\"1962\" data-end=\"2137\">For <strong data-start=\"1966\" data-end=\"1981\">inheritance<\/strong> matters, please also provide the deceased person\u2019s full name, date and place of birth, date and place of death, citizenship, and last address of residence.<\/p>\n<\/li>\n<\/ul>\n<p style=\"text-align: justify;\" data-start=\"2139\" data-end=\"2178\"><strong><span style=\"text-decoration: underline;\">Presence of the Parties \/ Witnesses<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\" data-start=\"2179\" data-end=\"2327\">A notarial act <strong data-start=\"2194\" data-end=\"2216\">cannot be executed<\/strong> by the consular officer unless the parties are present. <strong data-start=\"2273\" data-end=\"2290\">Two witnesses<\/strong> are required in the following cases:<\/p>\n<ul style=\"text-align: justify;\" data-start=\"2328\" data-end=\"2603\">\n<li data-start=\"2328\" data-end=\"2416\">\n<p data-start=\"2330\" data-end=\"2416\">General powers of attorney; <strong data-start=\"2358\" data-end=\"2371\">donations<\/strong>; <strong data-start=\"2373\" data-end=\"2395\">marital agreements<\/strong> and any amendments<\/p>\n<\/li>\n<li data-start=\"2417\" data-end=\"2480\">\n<p data-start=\"2419\" data-end=\"2480\">Declarations choosing the <strong data-start=\"2445\" data-end=\"2471\">separation of property<\/strong> regime<\/p>\n<\/li>\n<li data-start=\"2481\" data-end=\"2525\">\n<p data-start=\"2483\" data-end=\"2525\">Where any party <strong data-start=\"2499\" data-end=\"2523\">cannot read or write<\/strong><\/p>\n<\/li>\n<li data-start=\"2526\" data-end=\"2603\">\n<p data-start=\"2528\" data-end=\"2603\">Whenever a party or the consular officer requests the presence of witnesses<\/p>\n<\/li>\n<\/ul>\n<p style=\"text-align: justify;\" data-start=\"2605\" data-end=\"2780\">After the documentation is reviewed, the principal must <strong data-start=\"2661\" data-end=\"2681\">appear in person<\/strong> at the Consulate General with a valid ID and a <strong data-start=\"2729\" data-end=\"2744\">money order<\/strong> to pay the applicable consular fee.<\/p>\n<p style=\"text-align: justify;\" data-start=\"2782\" data-end=\"2876\">Some powers of attorney may also be signed at <strong data-start=\"2828\" data-end=\"2851\">Honorary Consulates<\/strong> within the jurisdiction.<\/p>\n<p style=\"text-align: justify;\" data-start=\"2878\" data-end=\"3060\"><strong data-start=\"2878\" data-end=\"2887\">Note:<\/strong> Consulates do <strong data-start=\"2902\" data-end=\"2909\">not<\/strong> provide legal advice and do <strong data-start=\"2938\" data-end=\"2945\">not<\/strong> draft customized texts. The Consulate assumes <strong data-start=\"2992\" data-end=\"3013\">no responsibility<\/strong> for the validity of texts prepared externally.<\/p>\n<p style=\"text-align: justify;\" data-start=\"3067\" data-end=\"3103\"><strong><span style=\"text-decoration: underline;\">Revocation of a Power of Attorney<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\" data-start=\"3105\" data-end=\"3243\">The person who granted a power of attorney may <strong data-start=\"3152\" data-end=\"3162\">revoke<\/strong> it at any time, unless the document expressly states that it is <strong data-start=\"3227\" data-end=\"3242\">irrevocable<\/strong>.<\/p>\n<p style=\"text-align: justify;\" data-start=\"3245\" data-end=\"3321\">To request revocation, please email <strong data-start=\"3281\" data-end=\"3309\"><a class=\"decorated-link cursor-pointer\" rel=\"noopener\" data-start=\"3283\" data-end=\"3307\">notarile.miami@esteri.it<\/a><\/strong> and attach:<\/p>\n<ul style=\"text-align: justify;\" data-start=\"3322\" data-end=\"3616\">\n<li data-start=\"3322\" data-end=\"3569\">\n<p data-start=\"3324\" data-end=\"3569\">A <strong data-start=\"3326\" data-end=\"3334\">copy<\/strong> of the power of attorney you intend to revoke or, if unavailable, all <strong data-start=\"3405\" data-end=\"3426\">essential details<\/strong> (for example: the Consulate or Notary who executed the act, date of issuance, record number, and the agent\u2019s complete personal details); and<\/p>\n<\/li>\n<li data-start=\"3570\" data-end=\"3616\">\n<p data-start=\"3572\" data-end=\"3616\">A <strong data-start=\"3574\" data-end=\"3586\">photo ID<\/strong> (Italian passport preferred).<\/p>\n<\/li>\n<\/ul>\n<p style=\"text-align: justify;\" data-start=\"3618\" data-end=\"3760\">You are responsible for <strong data-start=\"3642\" data-end=\"3665\">notifying the agent<\/strong> whose authority is being revoked, using a delivery method that <strong data-start=\"3729\" data-end=\"3759\">verifiably ensures receipt<\/strong>.<\/p>\n<p style=\"text-align: justify;\" data-start=\"3762\" data-end=\"3897\">If these formalities are not observed, the revocation may <strong data-start=\"3820\" data-end=\"3864\">not be enforceable against third parties<\/strong> in any subsequent legal dispute.<\/p>\n<p style=\"text-align: justify;\" data-start=\"3904\" data-end=\"3930\"><strong><span style=\"text-decoration: underline;\">Copies of Notarial Acts<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\" data-start=\"3932\" data-end=\"4261\" data-is-last-node=\"\" data-is-only-node=\"\">To request a <strong data-start=\"3945\" data-end=\"3971\">copy of a notarial act<\/strong> issued by this Consulate General, please email the Notary Office at <strong data-start=\"4040\" data-end=\"4068\"><a class=\"decorated-link cursor-pointer\" rel=\"noopener\" data-start=\"4042\" data-end=\"4066\">notarile.miami@esteri.it<\/a><\/strong> and provide the identifying details of the act (<strong data-start=\"4117\" data-end=\"4169\">type of act, date of issuance, and record number<\/strong>).<br data-start=\"4171\" data-end=\"4174\" \/>The officer in charge will reply with the information needed to finalize the procedure.<\/p>\n","protected":false},"excerpt":{"rendered":"A power of attorney authorizes another person to act on your behalf and to carry out the actions necessary to achieve a specific purpose (e.g., selling or purchasing property, managing assets, making or accepting a donation, forming or dissolving a company, etc.).
