Registration of Marriage Certificates Issued Outside Italy for Italian Citizens<\/strong><\/p>\n

If an Italian citizen, or both spouses, are Italian, their marriage must be registered in Italy. Additionally, if there are\u00a0previous marriages and divorces<\/strong>, these must be registered as well before proceeding with the new marriage registration.<\/p>\n

Required Documents for Marriage Registration in Italy<\/strong><\/p>\n

To register a marriage in Italy, the following documents must be submitted:<\/p>\n

    \n
  1. \n

    A\u00a0request form<\/strong><\/a>\u00a0for the registration of the marriage or civil union.<\/p>\n<\/li>\n

  2. \n

    The\u00a0marriage certificate<\/strong>, issued by the competent\u00a0Vital Statistics Office<\/strong>\u00a0of the country or state where the marriage took place. The certificate must include the\u00a0full names and dates of birth of both spouses<\/strong>, as well as information about any\u00a0previous marriages<\/strong>.<\/p>\n

    The document must be a\u00a0long-form certificate<\/strong>\u00a0or one that includes statistical information. If the marriage certificate does not provide details on previous marriages, a\u00a0Marriage License<\/strong>\u00a0must be included, along with its\u00a0Apostille and an Italian translation<\/strong>.<\/p>\n

    In most U.S. states, this document is referred to as a\u00a0\u201cMarriage Record.\u201d<\/strong>\u00a0In some states, the marriage certificate consists of four sections:\u00a0Application, License, Certificate, and a final section containing information on previous marriages<\/strong>. This final section\u00a0must be visible<\/strong>\u00a0and should not be cut or obscured.<\/p>\n<\/li>\n

  3. \n

    A\u00a0typewritten translation into Italian<\/strong>\u00a0of the marriage certificate. The translation can be completed by the applicant (if proficient) or by a\u00a0qualified translator<\/strong>. The entire certificate must be translated\u00a0word for word<\/strong>, with no summaries or conversions allowed.<\/p>\n<\/li>\n

  4. \n

    Apostille of the marriage certificate<\/strong>, issued by the competent authority of the country or state where the document was issued.<\/p>\n<\/li>\n

  5. \n

    Copies of the\u00a0Italian spouse\u2019s identity documents<\/strong>, including their\u00a0Italian Identity Card, Italian Passport, and Certificate of Italian Citizenship<\/strong>. A copy of the\u00a0non-Italian spouse\u2019s identification document<\/strong>\u00a0(passport or equivalent) must also be included.<\/p>\n<\/li>\n<\/ol>\n

    If the certificate is a document other than A4, and\/or printed on both sides, and\/or with glued attachments, please provide a copy of each side on a single face sheet.<\/strong><\/p>\n

    Legal Implications of Surrogacy for Italian Citizens<\/strong><\/p>\n

    With the enactment of\u00a0Law No. 169 of November 4, 2024<\/strong>, which comes into force on\u00a0December 3, 2024<\/strong>, surrogacy is now considered a crime for Italian citizens, even if it is carried out abroad. This means that Italian law applies regardless of whether surrogacy is legal in the foreign country where it took place.<\/p>\n

    Surrogacy is punishable under\u00a0Article 12, Paragraph 6 of Law No. 40 of February 19, 2004<\/strong>, which already provided sanctions for surrogacy performed on Italian national territory.<\/p>\n

    Consular Procedures Regarding Surrogacy<\/strong><\/p>\n

    In compliance with\u00a0Article 38, Paragraph 1 of Legislative Decree No. 71 of February 3, 2011<\/strong>, any\u00a0Italian consular authority<\/strong>\u00a0that receives a birth certificate for a child suspected of being born via surrogacy\u00a0must inform the competent Italian judicial authorities<\/strong>.
