Additionally, if there are\u00a0<strong data-start=\"215\" data-end=\"250\">previous marriages and divorces<\/strong>, these must be registered as well before proceeding with the new marriage registration.<\/p>\n<p style=\"text-align: justify;\" data-start=\"342\" data-end=\"405\"><strong data-start=\"346\" data-end=\"403\">Required Documents for Marriage Registration in Italy<\/strong><\/p>\n<p style=\"text-align: justify;\" data-start=\"407\" data-end=\"484\">To register a marriage in Italy, the following documents must be submitted:<\/p>\n<ol style=\"text-align: justify;\" data-start=\"486\" data-end=\"2144\">\n<li data-start=\"486\" data-end=\"562\">\n<p data-start=\"489\" data-end=\"562\">A<a href=\"https:\/\/consmiami.esteri.it\/wp-content\/uploads\/2023\/12\/trascrizioneattomatrimonio.pdf\">\u00a0<strong data-start=\"491\" data-end=\"507\">request form<\/strong><\/a>\u00a0for the registration of the marriage or civil union.<\/p>\n<\/li>\n<li data-start=\"564\" data-end=\"1452\">\n<p data-start=\"567\" data-end=\"846\">The\u00a0<strong data-start=\"571\" data-end=\"595\">marriage certificate<\/strong>, issued by the competent\u00a0<strong data-start=\"621\" data-end=\"648\">Vital Statistics Office<\/strong>\u00a0of the country or state where the marriage took place. The certificate must include the\u00a0<strong data-start=\"737\" data-end=\"786\">full names and dates of birth of both spouses<\/strong>, as well as information about any\u00a0<strong data-start=\"821\" data-end=\"843\">previous marriages<\/strong>.<\/p>\n<p data-start=\"851\" data-end=\"1121\">The document must be a\u00a0<strong data-start=\"874\" data-end=\"899\">long-form certificate<\/strong>\u00a0or one that includes statistical information. If the marriage certificate does not provide details on previous marriages, a\u00a0<strong data-start=\"1024\" data-end=\"1044\">Marriage License<\/strong>\u00a0must be included, along with its\u00a0<strong data-start=\"1078\" data-end=\"1118\">Apostille and an Italian translation<\/strong>.<\/p>\n<p data-start=\"1126\" data-end=\"1452\">In most U.S. states, this document is referred to as a\u00a0<strong data-start=\"1181\" data-end=\"1203\">\u201cMarriage Record.\u201d<\/strong>\u00a0In some states, the marriage certificate consists of four sections:\u00a0<strong data-start=\"1272\" data-end=\"1375\">Application, License, Certificate, and a final section containing information on previous marriages<\/strong>. This final section\u00a0<strong data-start=\"1396\" data-end=\"1415\">must be visible<\/strong>\u00a0and should not be cut or obscured.<\/p>\n<\/li>\n<li data-start=\"1454\" data-end=\"1733\">\n<p data-start=\"1457\" data-end=\"1733\">A\u00a0<strong data-start=\"1459\" data-end=\"1499\">typewritten translation into Italian<\/strong>\u00a0of the marriage certificate. The translation can be completed by the applicant (if proficient) or by a\u00a0<strong data-start=\"1603\" data-end=\"1627\">qualified translator<\/strong>. The entire certificate must be translated\u00a0<strong data-start=\"1671\" data-end=\"1688\">word for word<\/strong>, with no summaries or conversions allowed.<\/p>\n<\/li>\n<li data-start=\"1735\" data-end=\"1871\">\n<p data-start=\"1738\" data-end=\"1871\"><strong data-start=\"1738\" data-end=\"1779\">Apostille of the marriage certificate<\/strong>, issued by the competent authority of the country or state where the document was issued.<\/p>\n<\/li>\n<li data-start=\"1873\" data-end=\"2144\">\n<p data-start=\"1876\" data-end=\"2144\">Copies of the\u00a0<strong data-start=\"1890\" data-end=\"1929\">Italian spouse\u2019s identity documents<\/strong>, including their\u00a0<strong data-start=\"1947\" data-end=\"2030\">Italian Identity Card, Italian Passport, and Certificate of Italian Citizenship<\/strong>. A copy of the\u00a0<strong data-start=\"2046\" data-end=\"2094\">non-Italian spouse\u2019s identification document<\/strong>\u00a0(passport or equivalent) must also be included.<\/p>\n<\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><strong>\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>If the certificate is a document other than A4, and\/or printed on both sides, and\/or with glued attachments, please provide a copy of each side on a single face sheet.<\/strong><\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><strong>IMPORTANT NOTICES:<\/strong><\/p>\n<p style=\"text-align: justify;\" data-start=\"0\" data-end=\"62\"><strong data-start=\"4\" data-end=\"60\">Legal Implications of Surrogacy for Italian Citizens<\/strong><\/p>\n<p style=\"text-align: justify;\" data-start=\"64\" data-end=\"385\">With the enactment of\u00a0<strong data-start=\"86\" data-end=\"121\">Law No. 169 of November 4, 2024<\/strong>, which comes into force on\u00a0<strong data-start=\"149\" data-end=\"169\">December 3, 2024<\/strong>, surrogacy is now considered a crime for Italian citizens, even if it is carried out abroad. This means that Italian law applies regardless of whether surrogacy is legal in the foreign country where it took place.<\/p>\n<p style=\"text-align: justify;\" data-start=\"387\" data-end=\"570\">Surrogacy is punishable under\u00a0<strong data-start=\"417\" data-end=\"479\">Article 12, Paragraph 6 of Law No. 40 of February 19, 2004<\/strong>, which already provided sanctions for surrogacy performed on Italian national territory.<\/p>\n<p style=\"text-align: justify;\" data-start=\"572\" data-end=\"621\"><strong data-start=\"576\" data-end=\"619\">Consular Procedures Regarding Surrogacy<\/strong><\/p>\n<p style=\"text-align: justify;\" data-start=\"623\" data-end=\"1039\">In compliance with\u00a0<strong data-start=\"642\" data-end=\"718\">Article 38, Paragraph 1 of Legislative Decree No. 71 of February 3, 2011<\/strong>, any\u00a0<strong data-start=\"724\" data-end=\"754\">Italian consular authority<\/strong>\u00a0that receives a birth certificate for a child suspected of being born via surrogacy\u00a0<strong data-start=\"839\" data-end=\"897\">must inform the competent Italian judicial authorities<\/strong>.
