{"id":4975,"date":"2023-09-29T14:46:17","date_gmt":"2023-09-29T18:46:17","guid":{"rendered":"https:\/\/consmiami.esteri.it\/?page_id=4975"},"modified":"2026-03-04T13:05:23","modified_gmt":"2026-03-04T18:05:23","slug":"how-to-register-a-birth-2","status":"publish","type":"page","link":"https:\/\/consmiami.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/vital-statistics\/how-to-register-a-birth-2\/","title":{"rendered":"How to register a birth"},"content":{"rendered":"<h5 style=\"text-align: center;\" data-start=\"194\" data-end=\"246\"><strong>SECTION B \u2013 BIRTHS<\/strong><\/h5>\n<h6 style=\"text-align: center;\"><a href=\"https:\/\/consmiami.esteri.it\/wp-content\/uploads\/2026\/01\/tabella-riepilogo_ENG-nuova.pdf\">Easy Guide to Registering the Birth of an Italian Citizen\u2019s Child.<\/a><\/h6>\n<p style=\"text-align: center;\" data-start=\"194\" data-end=\"246\"><strong><span style=\"text-decoration: underline;\">Important communications \u2013 please read carefully<\/span><\/strong><\/p>\n<p data-start=\"248\" data-end=\"475\"><strong data-start=\"248\" data-end=\"314\">New procedures for citizenship applications by benefit of law.<\/strong><br data-start=\"314\" data-end=\"317\" \/>Applications will now be accepted only if submitted through the <a href=\"https:\/\/prenotami.esteri.it\/\">Prenot@mi<\/a> portal by selecting <strong data-start=\"415\" data-end=\"475\">\u201cTranscription of birth certificate for benefit of law.\u201d<\/strong><\/p>\n<p data-start=\"477\" data-end=\"662\"><strong>Important amendments to the citizenship law (Art. 4, paragraph 1-bis, letter B, Law 91\/1992) introduced by the 2026 Budget Law (Law of December 30, 2025, Art. 1, paragraph 513).<\/strong><\/p>\n<p data-start=\"477\" data-end=\"662\"><strong><span style=\"text-decoration: underline;\">NOTICE: the fee for citizenship by benefit of law is no longer required.<\/span><\/strong><\/p>\n<p data-start=\"664\" data-end=\"922\">The declarations for citizenship by benefit of law may be submitted <strong data-start=\"768\" data-end=\"786\">within 3 years<\/strong>, instead of within 1 year, from the child\u2019s birth or from the date filiation (including adoption) by an Italian citizen is established.<\/p>\n<p data-start=\"929\" data-end=\"955\"><strong>Mandatory requirements:<\/strong><\/p>\n<p data-start=\"957\" data-end=\"1038\">Before transcribing the child\u2019s birth, the following must already be transcribed:<\/p>\n<ul data-start=\"1040\" data-end=\"1099\">\n<li data-start=\"1040\" data-end=\"1061\">\n<p data-start=\"1042\" data-end=\"1061\">Parents\u2019 marriage<\/p>\n<\/li>\n<li data-start=\"1062\" data-end=\"1099\">\n<p data-start=\"1064\" data-end=\"1099\">Any divorce and previous marriage<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1101\" data-end=\"1250\">It is necessary to inform the Civil Status Office if the child has been adopted, in order to ensure correct registration and updating of records.<\/p>\n<h5 data-start=\"1257\" data-end=\"1336\"><strong>1. Citizenship <em data-start=\"1273\" data-end=\"1289\">jure sanguinis<\/em> (for minors) and citizenship by benefit of law<\/strong><\/h5>\n<p data-start=\"1338\" data-end=\"1647\">The new <strong data-start=\"1346\" data-end=\"1378\">Article 3-bis of Law 91\/1992<\/strong> limits the existing mechanisms for the transmission of citizenship and introduces new requirements for the recognition of Italian citizenship and the transcription of records in Italy.<br data-start=\"1563\" data-end=\"1566\" \/>These new provisions <strong data-start=\"1587\" data-end=\"1603\">DO NOT apply<\/strong> to minors born in Italy to Italian parents.<\/p>\n<h5 data-start=\"1654\" data-end=\"1704\">Italian citizenship by birth (<em data-start=\"1687\" data-end=\"1703\">jure sanguinis<\/em>)<\/h5>\n<p data-start=\"1706\" data-end=\"1931\">As of <strong data-start=\"1712\" data-end=\"1726\">03\/27\/2025<\/strong>, a minor born abroad to an Italian parent is recognized as an Italian citizen by birth only if, in addition to the requirements of the previous law, they fall into <strong data-start=\"1891\" data-end=\"1907\">at least one<\/strong> of the following cases.<\/p>\n<p data-start=\"1933\" data-end=\"1946\">The minor is:<\/p>\n<p data-start=\"1948\" data-end=\"2056\"><strong data-start=\"1948\" data-end=\"1954\">A.<\/strong> Child of an Italian citizen who, at the time of the child\u2019s birth, held <strong data-start=\"2027\" data-end=\"2055\">ONLY Italian citizenship<\/strong>.<\/p>\n<p data-start=\"2058\" data-end=\"2176\"><strong data-start=\"2058\" data-end=\"2064\">B.<\/strong> Child of an Italian citizen with multiple citizenships, who <strong data-start=\"2125\" data-end=\"2175\">lived in Italy for at least 2 continuous years<\/strong>:<\/p>\n<ul data-start=\"2178\" data-end=\"2260\">\n<li data-start=\"2178\" data-end=\"2227\">\n<p data-start=\"2180\" data-end=\"2227\">after recognition of Italian citizenship, and<\/p>\n<\/li>\n<li data-start=\"2228\" data-end=\"2260\">\n<p data-start=\"2230\" data-end=\"2260\">before the birth of the child.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2262\" data-end=\"2306\"><strong data-start=\"2262\" data-end=\"2268\">C.<\/strong> Grandchild of an Italian citizen who:<\/p>\n<ul data-start=\"2308\" data-end=\"2531\">\n<li data-start=\"2308\" data-end=\"2447\">\n<p data-start=\"2310\" data-end=\"2447\">held <strong data-start=\"2315\" data-end=\"2343\">ONLY Italian citizenship<\/strong> at the time of the grandchild\u2019s birth or at the time of their own death (if it occurred earlier), and<\/p>\n<\/li>\n<li data-start=\"2448\" data-end=\"2531\">\n<p data-start=\"2450\" data-end=\"2531\">where the child\u2019s parent was an Italian citizen at the time of the child\u2019s birth.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2533\" data-end=\"2592\"><strong data-start=\"2533\" data-end=\"2539\">D.<\/strong> The minor does not fall under cases A, B, or C, but:<\/p>\n<ul data-start=\"2594\" data-end=\"2742\">\n<li data-start=\"2594\" data-end=\"2742\">\n<p data-start=\"2596\" data-end=\"2742\"><strong data-start=\"2596\" data-end=\"2638\">does not possess any other citizenship<\/strong><br data-start=\"2638\" data-end=\"2641\" \/>\u2192 In this case, it is necessary to contact the Civil Status Office: <strong data-start=\"2711\" data-end=\"2742\"><a class=\"decorated-link cursor-pointer\" rel=\"noopener\" data-start=\"2713\" data-end=\"2740\">statocivile.miami@esteri.it\u00a0<\/a><\/strong><\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2749\" data-end=\"2762\"><strong>WHAT TO DO<\/strong><\/p>\n<p data-start=\"2764\" data-end=\"2796\">Send <strong data-start=\"2769\" data-end=\"2792\">EXCLUSIVELY by mail<\/strong> to:<\/p>\n<p data-start=\"2798\" data-end=\"2922\"><strong data-start=\"2798\" data-end=\"2837\">Consulate General of Italy in Miami<\/strong><br data-start=\"2837\" data-end=\"2840\" \/>4000 Ponce de Leon, STE 590<br data-start=\"2867\" data-end=\"2870\" \/>Coral Gables, FL 33146<br data-start=\"2892\" data-end=\"2895\" \/>Attn. Civil Status Office<\/p>\n<p data-start=\"2924\" data-end=\"2932\">Include:<\/p>\n<ul data-start=\"2934\" data-end=\"4826\">\n<li data-start=\"2934\" data-end=\"3025\">\n<p data-start=\"2936\" data-end=\"3025\"><a href=\"https:\/\/consmiami.esteri.it\/wp-content\/uploads\/2025\/07\/formulario_richiesta_trasc_nascita.pdf\">Application form for transcription of birth,<\/a> completed and signed by the Italian parent<\/p>\n<\/li>\n<li data-start=\"3026\" data-end=\"3383\">\n<p data-start=\"3028\" data-end=\"3383\">Original birth certificate with Apostille (or legalization for countries not party to the Hague Apostille Convention).<br data-start=\"3146\" data-end=\"3149\" \/>U.S. certificates must always be in <strong data-start=\"3187\" data-end=\"3206\">extended format<\/strong> (so-called <em data-start=\"3218\" data-end=\"3229\">Long Form<\/em> or <em data-start=\"3233\" data-end=\"3248\">Extended Form<\/em> indicating exact place of birth, date or age, and parents\u2019 places of birth), according to the issuing procedures of each U.S. state.<\/p>\n<\/li>\n<li data-start=\"3384\" data-end=\"3557\">\n<p data-start=\"3386\" data-end=\"3557\">Full Italian translation of the certificate, faithful to the original, with dates in <strong data-start=\"3471\" data-end=\"3489\">day\/month\/year<\/strong> format. Properly legalized if the birth occurred outside the USA.<\/p>\n<\/li>\n<li data-start=\"3558\" data-end=\"3695\">\n<p data-start=\"3560\" data-end=\"3695\">Copy of valid passports of both parents (photo page with personal data and signature) and the child\u2019s foreign passport, if available.<\/p>\n<\/li>\n<li data-start=\"3696\" data-end=\"3892\">\n<p data-start=\"3698\" data-end=\"3892\">Extract of the birth certificate of the Italian parent and of the Italian grandparent (in case C), complete with annotations, issued by the municipality of birth or AIRE registration in Italy.<\/p>\n<\/li>\n<li data-start=\"3893\" data-end=\"4095\">\n<p data-start=\"3895\" data-end=\"4095\">Declaration pursuant to DPR 445\/2000 listing the countries of residence of the parent and the grandparent (case C only) prior to the birth of the child\/grandchild, accompanied by the declarant\u2019s ID.<\/p>\n<\/li>\n<li data-start=\"4096\" data-end=\"4550\">\n<p data-start=\"4098\" data-end=\"4550\">Documentation proving <strong data-start=\"4120\" data-end=\"4142\">non-naturalization<\/strong> of the parent and\/or grandparent at the time of the child\u2019s\/grandchild\u2019s birth in the foreign countries of residence.<br data-start=\"4260\" data-end=\"4263\" \/><strong data-start=\"4265\" data-end=\"4274\">Note:<\/strong> sworn affidavits will not be accepted; only documentation issued by official sources, duly legalized and translated.<br data-start=\"4391\" data-end=\"4394\" \/>By way of example, to prove possession of Italian citizenship only, negative citizenship certificates, renunciation certificates, etc. may be submitted.<\/p>\n<\/li>\n<li data-start=\"4551\" data-end=\"4649\">\n<p data-start=\"4553\" data-end=\"4649\">Proof of residence within the consular jurisdiction (driver\u2019s license, lease agreement, etc.).<\/p>\n<\/li>\n<li data-start=\"4650\" data-end=\"4783\">\n<p data-start=\"4652\" data-end=\"4783\">Historical residence certificate of the Italian parent (case B only), to be requested from the municipality of AIRE registration.<\/p>\n<\/li>\n<li data-start=\"4784\" data-end=\"4826\">\n<p data-start=\"4786\" data-end=\"4826\">Child\u2019s foreign passport (if available).<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"4828\" data-end=\"4940\">When the above cases do <strong data-start=\"4852\" data-end=\"4859\">NOT<\/strong> apply, the minor is <strong data-start=\"4880\" data-end=\"4887\">not<\/strong> an Italian citizen by birth but may be eligible for:<\/p>\n<h5 data-start=\"4947\" data-end=\"4987\"><strong>2. Italian citizenship by benefit of law<\/strong><\/h5>\n<p data-start=\"4989\" data-end=\"5280\">Minor children born abroad to an Italian parent who does <strong data-start=\"5046\" data-end=\"5053\">not<\/strong> automatically transmit citizenship may acquire Italian citizenship.<br data-start=\"5121\" data-end=\"5124\" \/>The minor will become an Italian citizen <strong data-start=\"5165\" data-end=\"5183\">not from birth<\/strong>, but from the day following the fulfillment of the legal conditions (Article 15 of Law 91\/1992).<\/p>\n<p data-start=\"5287\" data-end=\"5329\"><strong>CASE 2.1 \u2013 Minor under 3 years of age<\/strong><\/p>\n<p data-start=\"5331\" data-end=\"5399\">The minor may obtain citizenship by benefit of law if the parent is:<\/p>\n<ul data-start=\"5401\" data-end=\"5480\">\n<li data-start=\"5401\" data-end=\"5480\">\n<p data-start=\"5403\" data-end=\"5480\">an Italian citizen by birth (<em data-start=\"5432\" data-end=\"5448\">jure sanguinis<\/em>) and holds other citizenships<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"5482\" data-end=\"5715\">The following are <strong data-start=\"5500\" data-end=\"5512\">excluded<\/strong>: citizens by naturalization (Art. 9 Law 91\/1992), benefit of law (Art. 4 Law 91\/1992 or Art. 10 Law 555\/1912), reacquisition (Arts. 13 or 17 Law 91\/1992), <em data-start=\"5670\" data-end=\"5692\">iuris communicatione<\/em> (Art. 14 Law 91\/1992).<\/p>\n<ul data-start=\"5717\" data-end=\"5787\">\n<li data-start=\"5717\" data-end=\"5787\">\n<p data-start=\"5719\" data-end=\"5787\">registered with AIRE and resident within the consular jurisdiction<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"5789\" data-end=\"5894\">Parents must submit a <strong data-start=\"5811\" data-end=\"5836\">declaration of intent<\/strong> to the Consulate <strong data-start=\"5854\" data-end=\"5893\">within 3 years of the child\u2019s birth<\/strong>.<\/p>\n<p data-start=\"5896\" data-end=\"5959\">For these declarations, the <strong data-start=\"5924\" data-end=\"5958\">\u20ac250 fee is no longer required<\/strong>.<\/p>\n<p data-start=\"5961\" data-end=\"6058\">For the procedure, see the sections <strong data-start=\"5997\" data-end=\"6028\">\u201cDOCUMENTS TO BE SUBMITTED\u201d<\/strong> and <strong data-start=\"6033\" data-end=\"6051\">\u201cHOW TO APPLY\u201d<\/strong> below.<\/p>\n<p data-start=\"6065\" data-end=\"6108\"><strong>CASE 2.2 \u2013 Minor over 3 years of age<\/strong><\/p>\n<p data-start=\"6110\" data-end=\"6202\">Citizenship by benefit of law may be requested through a declaration of intent if the minor:<\/p>\n<ul data-start=\"6204\" data-end=\"6421\">\n<li data-start=\"6204\" data-end=\"6318\">\n<p data-start=\"6206\" data-end=\"6318\">was under 18 on <strong data-start=\"6222\" data-end=\"6236\">05\/24\/2025<\/strong> and is the child of an Italian citizen recognized by <strong data-start=\"6290\" data-end=\"6304\">03\/27\/2025<\/strong>,<br data-start=\"6305\" data-end=\"6308\" \/><strong data-start=\"6310\" data-end=\"6316\">or<\/strong><\/p>\n<\/li>\n<li data-start=\"6319\" data-end=\"6421\">\n<p data-start=\"6321\" data-end=\"6421\">is the child of a person who already had an appointment scheduled on Prenot@mi as of <strong data-start=\"6406\" data-end=\"6420\">03\/27\/2025<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"6423\" data-end=\"6532\">The declaration of intent must be submitted <strong data-start=\"6467\" data-end=\"6511\">in person at the Consulate by 05\/31\/2029<\/strong>\u00a0by <strong data-start=\"6515\" data-end=\"6531\">both parents<\/strong>.<\/p>\n<p data-start=\"6534\" data-end=\"6628\">If the child has since reached the age of majority, the parents\u2019 presence is <strong data-start=\"6611\" data-end=\"6627\">not required<\/strong>.<\/p>\n<p data-start=\"6630\" data-end=\"6681\">For these declarations, the <strong data-start=\"5924\" data-end=\"5958\">\u20ac250 fee is no longer required<\/strong>.<\/p>\n<p data-start=\"6688\" data-end=\"6718\"><strong>DOCUMENTS TO BE SUBMITTED<\/strong><\/p>\n<p data-start=\"6719\" data-end=\"6751\">at the CONSULATE appointment<\/p>\n<ul data-start=\"6753\" data-end=\"7861\">\n<li data-start=\"6753\" data-end=\"6802\">\n<p data-start=\"6755\" data-end=\"6802\">Receipt of payment of the fee (if applicable)<\/p>\n<\/li>\n<li data-start=\"6803\" data-end=\"7032\">\n<p data-start=\"6805\" data-end=\"7032\">Original birth certificate of the
