Application Procedure<\/strong><\/h5>\n<p style=\"text-align: justify;\" data-start=\"230\" data-end=\"518\"><strong data-start=\"230\" data-end=\"269\">Law Decree No. 36 of March 28, 2025<\/strong>, was converted, with amendments, into <strong data-start=\"308\" data-end=\"338\">Law No. 74 of May 23, 2025<\/strong>, and came into effect on <strong data-start=\"364\" data-end=\"380\">May 24, 2025<\/strong>.<br data-start=\"381\" data-end=\"384\" \/>This conversion law modifies <strong data-start=\"413\" data-end=\"447\">Law No. 91 of February 5, 1992<\/strong>, the full updated version of which is available at the following<a href=\"https:\/\/www.normattiva.it\/uri-res\/N2Ls?urn:nir:stato:legge:1992-02-05;91!vig=\"> link<\/a>.<\/p>\n<p style=\"text-align: justify;\" data-start=\"520\" data-end=\"589\">Special attention is drawn to the newly introduced <strong data-start=\"571\" data-end=\"588\">Article 3-bis<\/strong>:<\/p>\n<blockquote data-start=\"591\" data-end=\"1087\">\n<p data-start=\"593\" data-end=\"1087\">By way of derogation from Articles 1, 2, 3, 14, and 20 of the present law; Article 5 of Law No. 123 of April 21, 1983; Articles 1, 2, 7, 10, 12, and 19 of Law No. 555 of June 13, 1912; and Articles 4, 5, 7, 8, and 9 of the Civil Code approved by Royal Decree No. 2358 of June 25, 1865, <strong data-start=\"879\" data-end=\"1055\">any individual born abroad \u2014 including before this article entered into force \u2014 and who holds another citizenship shall be deemed never to have acquired Italian citizenship<\/strong>, except in the following cases:<\/p>\n<\/blockquote>\n<ul style=\"text-align: justify;\" data-start=\"1089\" data-end=\"2165\">\n<li data-start=\"1089\" data-end=\"1401\">\n<p data-start=\"1091\" data-end=\"1401\"><strong data-start=\"1091\" data-end=\"1098\">(a)<\/strong> The applicant\u2019s Italian citizenship status is recognized, in accordance with the regulations in effect as of March 27, 2025, following submission of a complete application (with supporting documents) to the competent consular office or municipal authority by <strong data-start=\"1358\" data-end=\"1400\">11:59 PM (Rome time) on March 27, 2025<\/strong>;<\/p>\n<\/li>\n<li data-start=\"1405\" data-end=\"1672\">\n<p data-start=\"1407\" data-end=\"1672\"><strong data-start=\"1407\" data-end=\"1418\">(a-bis)<\/strong> The applicant\u2019s citizenship status is recognized, in accordance with the same regulations, based on an application submitted on the <strong data-start=\"1551\" data-end=\"1577\">date of an appointment<\/strong> communicated by the competent office <strong data-start=\"1615\" data-end=\"1671\">no later than 11:59 PM (Rome time) on March 27, 2025<\/strong>;<\/p>\n<\/li>\n<li data-start=\"1674\" data-end=\"1840\">\n<p data-start=\"1676\" data-end=\"1840\"><strong data-start=\"1676\" data-end=\"1683\">(b)<\/strong> The applicant\u2019s citizenship status is confirmed by a <strong data-start=\"1737\" data-end=\"1756\">judicial ruling<\/strong>, based on a lawsuit filed no later than <strong data-start=\"1797\" data-end=\"1839\">11:59 PM (Rome time) on March 27, 2025<\/strong>;<\/p>\n<\/li>\n<li data-start=\"1842\" data-end=\"1987\">\n<p data-start=\"1844\" data-end=\"1987\"><strong data-start=\"1844\" data-end=\"1851\">(c)<\/strong> A parent or grandparent (first or second degree ascendant) <strong data-start=\"1911\" data-end=\"1939\">held or exclusively held<\/strong> Italian citizenship at the time of their death;<\/p>\n<\/li>\n<li data-start=\"1989\" data-end=\"2165\">\n<p data-start=\"1991\" data-end=\"2165\"><strong data-start=\"1991\" data-end=\"1998\">(d)<\/strong> A parent or adoptive parent <strong data-start=\"2027\" data-end=\"2082\">resided in Italy for at least two consecutive years<\/strong> after acquiring Italian citizenship and before the birth or adoption of the child.<\/p>\n<\/li>\n<\/ul>\n<h5 style=\"text-align: justify;\" data-start=\"2172\" data-end=\"2298\"><strong>As such, under the new Law No. 91\/1992, Italian citizenship jure sanguinis (by descent, from birth) is recognized for:<\/strong><\/h5>\n<ul style=\"text-align: justify;\" data-start=\"2300\" data-end=\"2574\">\n<li data-start=\"2300\" data-end=\"2344\">\n<p data-start=\"2302\" data-end=\"2344\">Applicants <strong data-start=\"2313\" data-end=\"2330\">born in Italy<\/strong>, at any time;<\/p>\n<\/li>\n<li data-start=\"2345\" data-end=\"2459\">\n<p data-start=\"2347\" data-end=\"2459\">Applicants who <strong data-start=\"2362\" data-end=\"2402\">hold exclusively Italian citizenship<\/strong>, i.e., who do not and cannot hold any other citizenship;<\/p>\n<\/li>\n<li data-start=\"2460\" data-end=\"2574\">\n<p data-start=\"2462\" data-end=\"2574\">Applicants who fall under one of the categories listed in <strong data-start=\"2520\" data-end=\"2573\">points a), a-bis), b), c), or d) of Article 3-bis<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<h5 style=\"text-align: justify;\" data-start=\"2581\" data-end=\"2618\"><strong>Clarifications under the new law:<\/strong><\/h5>\n<ol style=\"text-align: justify;\" data-start=\"2620\" data-end=\"3482\">\n<li data-start=\"2620\" data-end=\"2992\">\n<p data-start=\"2623\" data-end=\"2788\"><strong data-start=\"2623\" data-end=\"2700\">Only applications submitted before 11:59 PM (Rome time) on March 27, 2025<\/strong>, with all required documentation, will be processed under the previous legal framework.<\/p>\n<p data-start=\"2793\" data-end=\"2836\">Applications are considered \u201csubmitted\u201d if:<\/p>\n<ul data-start=\"2840\" data-end=\"2992\">\n<li data-start=\"2840\" data-end=\"2903\">\n<p data-start=\"2842\" data-end=\"2903\">Sent by mail with a verifiable timestamp before the deadline;<\/p>\n<\/li>\n<li data-start=\"2907\" data-end=\"2992\">\n<p data-start=\"2909\" data-end=\"2992\">Sent without timestamp but <strong data-start=\"2936\" data-end=\"2991\">received by the Consular Office before the deadline<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li data-start=\"2994\" data-end=\"3414\">\n<p data-start=\"2997\" data-end=\"3212\">Applications submitted <strong data-start=\"3020\" data-end=\"3047\">on the appointment date<\/strong> confirmed by the competent office <strong data-start=\"3082\" data-end=\"3131\">before 11:59 PM (Rome time) on March 27, 2025<\/strong>, and accompanied by complete documentation, will also follow the previous rules.<\/p>\n<p data-start=\"3217\" data-end=\"3414\">An &#8220;appointment confirmed by the competent office&#8221; refers to email confirmation sent through the <strong data-start=\"3314\" data-end=\"3334\">Prenot@mi portal<\/strong> or the official email address of the consular section handling the application.<\/p>\n<\/li>\n<li data-start=\"3416\" data-end=\"3482\">\n<p data-start=\"3419\" data-end=\"3482\"><strong data-start=\"3419\" data-end=\"3445\">All other applications<\/strong> will follow the <strong data-start=\"3462\" data-end=\"3481\">new regulations<\/strong>.<\/p>\n<\/li>\n<\/ol>\n<h5 style=\"text-align: justify;\" data-start=\"3489\" data-end=\"3514\"><strong>APPLICATION PROCEDURE<\/strong><\/h5>\n<p style=\"text-align: justify;\" data-start=\"3516\" data-end=\"3909\">Applications may be submitted to the <strong data-start=\"3553\" data-end=\"3592\">Consulate General of Italy in Miami<\/strong> <strong data-start=\"3593\" data-end=\"3601\">only<\/strong> if the applicant <strong data-start=\"3619\" data-end=\"3654\">legally and permanently resides<\/strong> in one of the following territories: Florida, Georgia, South Carolina, Alabama, Mississippi, Puerto Rico, U.S. Virgin Islands, British Virgin Islands, Cayman Islands, Dutch islands of St. Maarten, St. Eustatius and Saba, Turks and Caicos, or the Bahamas.<\/p>\n<p style=\"text-align: justify;\" data-start=\"3911\" data-end=\"4066\">Applicants seeking recognition of Italian citizenship <strong data-start=\"3965\" data-end=\"3996\">by descent (jure sanguinis)<\/strong> must schedule an appointment through the <strong data-start=\"4038\" data-end=\"4065\">online Prenot@mi system<\/strong>.<\/p>\n<p style=\"text-align: justify;\" data-start=\"4068\" data-end=\"4195\">Approximately one month prior to the appointment date, applicants will receive instructions regarding documentation submission.<\/p>\n<h5 style=\"text-align: justify;\" data-start=\"4202\" data-end=\"4233\"><strong>CITIZENSHIP APPLICATION FEE<\/strong><\/h5>\n<p style=\"text-align: justify;\" data-start=\"4235\" data-end=\"4423\">As of <strong data-start=\"4241\" data-end=\"4260\">January 1, 2025<\/strong>, all applications for the recognition of Italian citizenship <strong data-start=\"4322\" data-end=\"4340\">jure sanguinis<\/strong> are subject to a <strong data-start=\"4358\" data-end=\"4397\">non-refundable consular fee of \u20ac600<\/strong>, payable in U.S. dollars.<\/p>\n<p style=\"text-align: justify;\" data-start=\"4425\" data-end=\"4608\">The amount in dollars is subject to exchange rate fluctuations and can be checked on the <strong data-start=\"4514\" data-end=\"4572\"><a href=\"https:\/\/consmiami.esteri.it\/wp-content\/uploads\/2025\/12\/Estratto-tabella-consolare-IV-trimestre-2025-dal-01.12.2025.pdf\">Consular Fees Table<\/a> \u2013 Article 7-bis, updated quarterly<\/strong> on the <a href=\"https:\/\/consmiami.esteri.it\/it\/news\/dal_consolato\/2016\/08\/tabella-percezioni-consolari-del\/\">Consulate General&#8217;s website<\/a>.<\/p>\n<p style=\"text-align: justify;\" data-start=\"4610\" data-end=\"4834\"><strong data-start=\"4610\" data-end=\"4629\">Payment method:<\/strong> Money Order <strong data-start=\"4642\" data-end=\"4672\">(not from Bank of America)<\/strong> made payable to the <strong data-start=\"4693\" data-end=\"4732\">Consulate General of Italy in Miami<\/strong>.<br data-start=\"4733\" data-end=\"4736\" \/><strong data-start=\"4736\" data-end=\"4761\">Cash is not accepted.<\/strong><br data-start=\"4761\" data-end=\"4764\" \/><strong data-start=\"4764\" data-end=\"4834\">Please note: The fee is non-refundable, regardless of the outcome.<\/strong><\/p>\n<h5 style=\"text-align: justify;\" data-start=\"4841\" data-end=\"4867\"><strong>REQUIRED DOCUMENTATION<\/strong><\/h5>\n<p Documentation required under Circular K.28.1 of April 8, 1991 from the Italian Ministry of the Interior, specifically:<\/strong><\/p>\n<ol style=\"text-align: justify;\" data-start=\"5022\" data-end=\"5897\">\n<li data-start=\"5022\" data-end=\"5156\">\n<p data-start=\"5025\" data-end=\"5156\">Application forms (Forms <a href=\"https:\/\/consmiami.esteri.it\/wp-content\/uploads\/2023\/11\/FORM-1.docx\"><strong>\u00a01<\/strong><\/a><strong>,<\/strong><a href=\"https:\/\/consmiami.esteri.it\/wp-content\/uploads\/2023\/11\/FORM-2.docx\"><strong> 2<\/strong><\/a><strong>,<\/strong><a href=\"https:\/\/consmiami.esteri.it\/wp-content\/uploads\/2023\/11\/FORM-3.docx\"><strong> 3<\/strong><\/a><strong> and<\/strong><a href=\"https:\/\/consmiami.esteri.it\/wp-content\/uploads\/2023\/11\/FORM-4.docx\"><strong>\u00a04<\/strong><\/a>), must be signed in front of a <strong data-start=\"5117\" data-end=\"5134\">Notary Public<\/strong> and <strong data-start=\"5139\" data-end=\"5153\">apostilled<\/strong>;<\/p>\n<\/li>\n<li data-start=\"5157\" data-end=\"5284\">\n<p data-start=\"5160\" data-end=\"5284\">Birth certificate (estratto dell\u2019atto di nascita) of the Italian ancestor issued by the <strong data-start=\"5248\" data-end=\"5281\">Italian municipality of birth<\/strong>;<\/p>\n<\/li>\n<li data-start=\"5285\" data-end=\"5404\">\n<p data-start=\"5288\" data-end=\"5404\">Birth certificates of <strong data-start=\"5310\" data-end=\"5336\">all direct descendants<\/strong>, including the applicant, <strong data-start=\"5363\" data-end=\"5401\">with official Italian translations<\/strong>;<\/p>\n<\/li>\n<li data-start=\"5405\" data-end=\"5511\">\n<p data-start=\"5408\" data-end=\"5511\">Marriage certificate of the Italian ancestor, <strong data-start=\"5454\" data-end=\"5508\">with official Italian translation if issued abroad<\/strong>;<\/p>\n<\/li>\n<li data-start=\"5512\" data-end=\"5604\">\n<p data-start=\"5515\" data-end=\"5604\">Marriage certificates of <strong data-start=\"5540\" data-end=\"5566\">all direct descendants<\/strong>, including the applicant\u2019s parents;<\/p>\n<\/li>\n<li data-start=\"5605\" data-end=\"5841\">\n<p data-start=\"5608\" data-end=\"5841\">Certificate issued by the competent authorities of the foreign country of emigration (with Italian translation), confirming that the Italian ancestor <strong data-start=\"5758\" data-end=\"5838\">did not acquire foreign citizenship during the minor age of their descendant<\/strong>;<\/p>\n<\/li>\n<li data-start=\"5842\" data-end=\"5897\">\n<p data-start=\"5845\" data-end=\"5897\">Proof of residence within the consular jurisdiction.<\/p>\n<\/li>\n<\/ol>\n<p style=\"text-align: justify;\" data-start=\"5899\" data-end=\"5957\"><strong data-start=\"5899\" data-end=\"5957\">2. Additional documents under the new legal framework:<\/strong><\/p>\n<p style=\"text-align: justify;\" data-start=\"5959\" data-end=\"6039\">To prove <strong data-start=\"5968\" data-end=\"6015\">exclusive possession of Italian citizenship<\/strong> (examples may include):<\/p>\n<ul style=\"text-align: justify;\" data-start=\"6040\" data-end=\"6175\">\n<li data-start=\"6040\" data-end=\"6076\">\n<p data-start=\"6042\" data-end=\"6076\">Negative citizenship certificates;<\/p>\n<\/li>\n<li data-start=\"6077\" data-end=\"6118\">\n<p data-start=\"6079\" data-end=\"6118\">Statements of citizenship renunciation;<\/p>\n<\/li>\n<li data-start=\"6119\" data-end=\"6175\">\n<p data-start=\"6121\" data-end=\"6175\">Certificates of non-enrollment in electoral registers.<\/p>\n<\/li>\n<\/ul>\n<p style=\"text-align: justify;\" data-start=\"6177\" data-end=\"6243\">To prove <strong data-start=\"6186\" data-end=\"6242\">residency in Italy for at least two continuous years<\/strong>:<\/p>\n<ul style=\"text-align: justify;\" data-start=\"6244\" data-end=\"6291\">\n<li data-start=\"6244\" data-end=\"6291\">\n<p data-start=\"6246\" data-end=\"6291\">Historical certificate of residency in Italy.<\/p>\n<\/li>\n<\/ul>\n<h5 style=\"text-align: justify;\" data-start=\"6298\" data-end=\"6317\"><strong>IMPORTANT NOTES<\/strong><\/h5>\n<ul style=\"text-align: justify;\" data-start=\"6319\" data-end=\"6995\">\n<li data-start=\"6319\" data-end=\"6471\">\n<p data-start=\"6321\" data-end=\"6471\">The <strong data-start=\"6325\" data-end=\"6384\">entire required documentation must be submitted at once<\/strong>. Incomplete submissions will not be processed, and no clarifications will be provided.<\/p>\n<\/li>\n<li data-start=\"6472\" data-end=\"6633\">\n<p data-start=\"6474\" data-end=\"6633\">All documents must be <strong data-start=\"6496\" data-end=\"6509\">originals<\/strong> and duly legalized (i.e., apostilled or authenticated) if issued <strong data-start=\"6575\" data-end=\"6632\">outside of this consular district or outside the U.S.<\/strong>.<\/p>\n<\/li>\n<li data-start=\"6634\" data-end=\"6995\">\n<p data-start=\"6636\" data-end=\"6995\">If your family members have submitted documents regarding common ancestors at <strong data-start=\"6714\" data-end=\"6759\">another Consulate or Italian municipality<\/strong>, you must still submit <strong data-start=\"6783\" data-end=\"6804\">all documentation<\/strong> listed above.<br data-start=\"6818\" data-end=\"6821\" \/>Only in cases where the <strong data-start=\"6847\" data-end=\"6869\">entire family unit<\/strong> has submitted a <strong data-start=\"6886\" data-end=\"6904\">jure sanguinis<\/strong> application to <strong data-start=\"6920\" data-end=\"6943\">this same Consulate<\/strong>, the documents for shared ancestors may be omitted.<\/p>\n<\/li>\n<\/ul>\n<p style=\"text-align: justify;\" data-start=\"6997\" data-end=\"7195\">The <strong data-start=\"7001\" data-end=\"7054\">Citizenship Office does not perform pre-screening<\/strong> of documents.<br data-start=\"7068\" data-end=\"7071\" \/><strong data-start=\"7071\" data-end=\"7100\">Unsolicited documentation<\/strong> (not tied to a scheduled appointment) will not be reviewed, and no responses will be provided.<\/p>\n<h5 style=\"text-align: justify;\" data-start=\"7202\" data-end=\"7251\"><strong>NEW INTERPRETIVE GUIDELINES ON JURE SANGUINIS<\/strong><\/h5>\n<p style=\"text-align: justify;\" data-start=\"7253\" data-end=\"7565\">We draw applicants&#8217; attention to significant updates introduced by recent rulings of the <strong data-start=\"7342\" data-end=\"7380\">Italian Supreme Court of Cassation<\/strong> (Civil Section I, Orders No. 454\/2024 and No. 17161\/2023), and <strong data-start=\"7444\" data-end=\"7485\">Circular No. 43347 of October 3, 2024<\/strong>, issued by the Ministry of the Interior in application of these new guidelines.<\/p>\n<p style=\"text-align: justify;\" data-start=\"7567\" data-end=\"8048\">The circular confirms the Court\u2019s position that <strong data-start=\"7615\" data-end=\"7682\">an Italian citizen who voluntarily acquired foreign nationality<\/strong> under the 1912 law (or earlier Civil Code of 1865) <strong data-start=\"7734\" data-end=\"7830\">simultaneously caused the loss of Italian citizenship for their minor child living with them<\/strong>.<br data-start=\"7831\" data-end=\"7834\" \/>This applies <strong data-start=\"7847\" data-end=\"7915\">even when the child was born in a country like the United States<\/strong>, where citizenship is granted by <strong data-start=\"7949\" data-end=\"7961\">jus soli<\/strong> \u2014 meaning the child was both Italian by <strong data-start=\"8002\" data-end=\"8019\">jus sanguinis<\/strong> and a U.S. citizen by birth.<\/p>\n<p style=\"text-align: justify;\" data-start=\"8050\" data-end=\"8247\">In such cases, the transmission of citizenship is considered <strong data-start=\"8111\" data-end=\"8126\">interrupted<\/strong>, as the child no longer had the capacity to pass on citizenship to future descendants after the parent\u2019s naturalization.<\/p>\n<p style=\"text-align: justify;\" data-start=\"8249\" data-end=\"8553\"><strong data-start=\"8249\" data-end=\"8260\">However<\/strong>, the applicant may still prove that the ancestor who lost Italian citizenship <strong data-start=\"8339\" data-end=\"8379\">regained it after reaching adulthood<\/strong>.
